1. Service Provider & Introduction
YoZombie is provided by, and you are contracting with:
YoZombie, L.L.C.

Organized under the laws of the State of Maryland, United States of America.
By accessing or using the YoZombie platform ("YoZombie," "we," "us," or "our"), you agree to these Terms of Service ("Terms"), which govern your use of the YoZombie platform and related services (the "Platform").
These Terms form a binding legal agreement between you, the Personal User, and YoZombie, L.L.C. They apply only when you use a Personal account or Personal-account features to post, manage, or pay for fixed-price personal, household, or residential Gigs. Businesses are governed by the separate YoZombie Terms of Service for Businesses. Workers are governed by the separate YoZombie Terms of Service for Workers.
If you maintain more than one YoZombie role, these Terms apply only when you access or use Personal-account features. The terms governing another role apply when you use that role.
By creating a Personal account, clicking "I Agree," posting a Residential Gig, or otherwise using Personal-account features, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated by reference. If you do not agree, you must not use Personal-account features.
Marketplace Notice: YoZombie provides technology that connects Personal Users with Workers. YoZombie does not perform the work described in any Gig, does not employ Workers, does not supervise or direct how work is performed, and is not a party to the separate service agreement formed between a Personal User and a Worker.
Important Residential Notice: Personal Users may be inviting an individual onto or near private property. YoZombie does not independently verify or guarantee a Worker's identity, background, skills, insurance, licensing, suitability, or trustworthiness. You are responsible for deciding whether a Worker and a proposed task are appropriate for your property and circumstances.
2. Age and Legal Capacity Requirements
You must be at least eighteen (18) years old and have the legal capacity to enter into binding contracts to create or use a Personal account. By using the Platform, you represent and warrant that you satisfy these requirements.
A minor may not create a Personal account, post a Gig, accept these Terms, provide payment credentials, or direct a Worker through the Platform. You may not create or operate an account on behalf of a minor.
If YoZombie reasonably believes an account holder is under 18 or lacks legal capacity, YoZombie may suspend or terminate the account and take any payment, refund, record-retention, or safety action reasonably necessary under these Terms and applicable law.
3. Definitions
For clarity and consistency, the following definitions apply throughout these Terms. Defined terms include their singular and plural forms and related grammatical variations.
"Personal User" means an individual who registers for or uses a Personal account for a personal, household, or residential need. A Personal User may also be called a "Personal Poster," "Poster," "you," or "your." A person acting for a business, rental operation, property-management company, nonprofit, organization, or other commercial purpose is not a Personal User for that activity and must use the appropriate Business account.
"Worker" means an individual who uses a Worker account to view, accept, perform, and complete Gigs. YoZombie does not employ Workers. A Worker is not an agent, representative, or partner of YoZombie.
"Residential Gig" means a fixed-price Gig posted through a Personal account for a personal, household, or residential need and displayed to Workers as Residential. Each Residential Gig currently permits only one assigned Worker.
"QR-Required Residential Gig" means a Residential Gig that requires the Worker to scan the Personal User's check-in QR before beginning work and that is completed when either the Worker scans the checkout QR or the Personal User confirms completion directly in the app.
"Remote Residential Gig" or "No-QR Residential Gig" means a Residential Gig that does not use check-in or checkout QR codes. The Worker submits completion through the Platform, and payment is released only after the Personal User accepts the completed Gig or YoZombie takes another payment action permitted by these Terms.
"Gig" means a short-term, temporary, or on-demand work opportunity created through the Platform and accepted by one Worker. Each accepted Gig forms a separate agreement between the Poster and the Worker.
"Marketplace" means the Platform functionality that enables Personal Users and Workers to find each other, communicate, and enter into separate service arrangements directly. YoZombie provides the Marketplace and related technology tools but is not a party to the service arrangement.
"Platform" or "YoZombie Platform" means YoZombie's mobile application, website, software, systems, features, and related services.
"Worker Pay" means the gross fixed amount offered by the Personal User and accepted by the Worker for completing the stated Residential Gig. Worker Pay is not hourly pay and may be reduced only by applicable receiver-side Transaction Fees or adjustments permitted by Stripe, applicable law, or these Terms.
"Platform Fee" means the flat fee charged by YoZombie for a Residential Gig, as disclosed before posting and payment. Platform Fees are paid by the Personal User and are not wages or compensation to the Worker.
"Transaction Fees" means payment-processing, card-network, banking, transfer, payout, or similar fees charged by Stripe or another payment provider. The Personal User is responsible for payer-side Transaction Fees. The Worker is responsible for receiver-side Transaction Fees. YoZombie does not absorb or reimburse Transaction Fees unless it expressly states otherwise.
"Stripe Connect" means the third-party payment-processing services integrated into the Platform to facilitate charges, payment holds or delayed transfers, payouts, refunds, reversals, and related payment functions. YoZombie does not act as a bank, money transmitter, or escrow agent and does not take custody of funds.
"Full Refund" means a refund of the refundable amount charged for the Gig, including Worker Pay and the ordinary Platform Fee, less any Transaction Fees that Stripe or another payment provider does not return or that otherwise remain payable. YoZombie does not retain its ordinary Platform Fee when a Full Refund applies.
"Scheduled Start Time" means the start date and time displayed in the Platform for the Residential Gig, based on Platform records and server timestamps.
"Requested Completion Time" means the date and time by which the Personal User requests that a Remote Residential Gig be completed and submitted through the Platform.
"User Content" means text, photos, videos, notes, reviews, ratings, messages, Gig descriptions, completion submissions, and other content uploaded, transmitted, or provided through the Platform.
"Account" means the registered Personal profile used to access Personal-account features, including account details, payment records, Gig history, messages, ratings, and private saved-worker records.

5. Relationship of the Parties
5.1 Neutral Technology Marketplace
YoZombie operates solely as a technology marketplace that connects Personal Users with Workers for short-term Residential Gigs. YoZombie does not provide the services described in a Gig and does not control or direct the manner or means by which a Worker performs the work.
5.2 Separate Agreement Between Personal User and Worker
When a Worker accepts a Residential Gig, a separate and direct service agreement is formed between the Personal User and that Worker based on the posted scope, fixed Worker Pay, schedule, location, verification method, and other disclosed requirements. YoZombie is not a party to that agreement and does not guarantee its performance, quality, safety, timeliness, or outcome.
5.3 No Employment, Agency, Partnership, or Ongoing Relationship
Nothing in these Terms or use of the Platform creates employment, agency, partnership, joint venture, franchise, fiduciary, or representative status between YoZombie and any Personal User or Worker. A Personal User and Worker have no authority to bind YoZombie or act on YoZombie's behalf.
Residential Gigs are intended to be separate, short-term, fixed-price arrangements. Personal Users may not use the Personal side for hourly shifts, recurring schedules, ongoing household staff, or any arrangement intended to function as employment. A saved Worker, repeat use of the same Worker, or a direct offer does not create exclusivity or an obligation to offer or accept future work.
5.4 No Background Checks, Identity Guarantee, or Suitability Determination
YoZombie does not independently verify or guarantee a Worker's identity and does not conduct criminal background checks, reference checks, employment screenings, driving-record checks, insurance verification, license verification, or suitability determinations. Stripe may collect or verify information required to establish and maintain a connected payout account. Stripe's payment-account verification is not a YoZombie background check or a representation that a Worker is safe, qualified, trustworthy, licensed, insured, or accurately identified.
Personal Users are solely responsible for assessing whether a Worker is suitable for the specific task, property, access level, items, vehicles, tools, and circumstances involved. You should not provide access to private living areas, financial information, valuables, weapons, keys, alarm codes, confidential documents, or other sensitive property unless you independently decide it is necessary and appropriate and accept the associated risk.
5.5 Authority to Use the Property and Request the Work
You represent and warrant that you own, lawfully occupy, or are otherwise authorized to control the property, items, access rights, pickup location, delivery location, or materials involved in each Residential Gig. You may not post work on another person's property or dispose of another person's belongings without authorization.
5.6 Taxes, Classification, and Other Legal Obligations
YoZombie does not withhold or remit taxes, provide workers' compensation, provide unemployment insurance, or determine the legal classification of a Worker in relation to a Personal User. The classification and legal obligations arising from a particular arrangement depend on the actual facts and applicable law. Each party is responsible for its own taxes, insurance, permits, licenses, and other legal duties.
5.7 Non-Waivable Consumer Rights
Nothing in these Terms limits any right or remedy that cannot lawfully be waived under applicable consumer-protection, payment, privacy, safety, or other mandatory law. Where these Terms conflict with a non-waivable legal protection, the mandatory law controls only to the extent of the conflict.
6. Using the Personal Platform
6.1 Overview
The Personal side allows an individual to post and manage fixed-price Residential Gigs for personal, household, or residential needs. Workers use the same Worker account to view both Business and Residential opportunities, and Residential Gigs are clearly labeled as Residential before acceptance.
6.2 Personal and Noncommercial Use Only
A Personal account may be used only for your own personal, household, or residential need. You may not use a Personal account to obtain labor for a business, sole proprietorship, rental property operation, short-term rental operation, property-management company, association, nonprofit, organization, resale activity, or other commercial or professional purpose. Commercial needs must be posted through the Business side and are governed by the Business Terms.
6.3 Current Residential Gig Limits
Unless YoZombie expressly enables a different feature and provides additional terms, every Residential Gig is:
- created for one Worker only;
- fixed-price only and not calculated by the hour;
- a separate, short-term task rather than recurring or ongoing work;
- limited to categories and access conditions enabled on the Personal side; and
- generally intended for outdoor, driveway, curbside, garage, pickup, delivery, moving, hauling, cleanup, and similar tasks that are appropriate for one Worker.
6.4 Accurate Posting Requirements
You must provide complete, accurate, and non-misleading information before posting, including:
- the exact task and expected result;
- the approximate number, size, type, condition, and weight of items;
- the location and relevant access, parking, traffic, gate, stair, distance, terrain, and timing information;
- whether lifting, carrying, driving, loading, unloading, disposal, tools, equipment, or materials are required;
- known hazards, sharp objects, pests, unstable items, weather exposure, restricted areas, or other material conditions;
- the fixed Worker Pay, Scheduled Start Time, Requested Completion Time, and selected verification method; and
- any lawful and reasonable requirements necessary for coordination, safety, or completion.
You are responsible for the Gig description. YoZombie does not inspect the property or items, approve the scope, calculate a safe weight, determine the number of Workers required, or guarantee that the description is complete. A task that reasonably requires more than one person may not be divided or described misleadingly to fit the one-Worker limit.
6.5 Location and Address Disclosure
Before acceptance, the Platform may show Workers the ZIP code, county, approximate area, or other general location information needed to evaluate the opportunity. The exact address and additional access information become available only after a Worker accepts, subject to Platform functionality and safety controls.
You must provide a lawful, accurate, and serviceable location. You may not direct a Worker to trespass, enter a restricted area, block traffic unlawfully, violate parking rules, or access property without authorization.
6.6 Fixed Worker Pay and Schedule
You choose the total fixed Worker Pay for completing the entire stated Residential Gig. The Worker may accept or decline that offer. Acceptance creates agreement to the fixed amount and posted terms. Estimated duration, if displayed, is for planning only and does not convert the Gig to hourly pay.
You must select a Scheduled Start Time and a requested completion deadline. The completion deadline is part of the accepted Gig terms and controls certain Remote Residential cancellation rights described in Section 8.
6.7 Choosing the Verification Method
Before posting, you must choose one of two different completion systems. The selected system is displayed to the Worker before acceptance and may not be changed after acceptance without the Worker's agreement and any Platform process required by YoZombie.
QR-Required Residential Gig. You agree to be available to display the check-in QR before work begins. When the work is finished, you will either display the checkout QR for the Worker to scan or confirm completion directly in the app. You must not instruct or pressure a Worker to begin before a successful check-in.
Remote Residential Gig. No QR code is used. You authorize the Worker to access and complete the stated task without an in-person QR exchange. The Worker submits completion through the Platform, and you review the submission and either accept the Gig as completed, communicate about a problem, or use Report an Issue when appropriate.
6.8 Review, Payment, and Posting
Before the Gig becomes active, the Platform displays the scope, location, Worker Pay, schedule, completion deadline, verification method, cancellation rules, Platform Fee, applicable payer-side Transaction Fees, and total charge. You are responsible for reviewing these terms before paying and posting.
At posting, Stripe processes the total charge for the Gig, which may include Worker Pay, the Platform Fee, and applicable payer-side Transaction Fees. The portion designated as Worker Pay is not transferred to the Worker merely because the Gig is posted or accepted. Payment release occurs only through the applicable completion action or another payment action permitted under these Terms.
6.9 Stripe Connect; No Bank, Money Transmitter, or Escrow Role
All Gig payments, transfers, payouts, refunds, reversals, and related payment actions are processed through Stripe Connect. YoZombie does not act as a bank, money transmitter, or escrow agent and does not take custody of funds. Payment availability, processing time, risk reviews, holds, reversals, and refunds remain subject to Stripe's rules, card networks, banks, and applicable law.
6.10 Platform Fees
Personal Users pay a flat Platform Fee for each Residential Gig based on the listed Worker Pay, as disclosed before payment submission:
- $0-$99 Worker Pay: $12 Platform Fee
- $100-$149 Worker Pay: $15 Platform Fee
- $150-$249 Worker Pay: $20 Platform Fee
- $250 or more Worker Pay: $25 Platform Fee
YoZombie may update fees from time to time. Updated fees apply only to Gigs posted after the new fee becomes effective and will be disclosed before payment. Optional features may carry additional charges disclosed before purchase.
6.11 Worker Pay and Transaction Fees
YoZombie does not deduct a commission, percentage, or Platform Fee from Worker Pay. The Worker may receive Worker Pay less applicable receiver-side Transaction Fees. You are responsible for payer-side Transaction Fees in addition to Worker Pay and the Platform Fee.
6.12 Receipts, Payment Records, and Failed Payments
You may view receipts, Gig details, and payment status in the Platform. YoZombie may retain transaction and Gig records as reasonably necessary for payment administration, fraud prevention, reports, legal compliance, tax and accounting obligations, and chargeback defense.
YoZombie is not responsible for payment delays, failures, reversals, or interruptions caused by Stripe, banks, card networks, incorrect payment information, insufficient funds, chargebacks, compliance reviews, identity verification, sanctions screening, or risk controls. YoZombie may pause or restrict related Gig activity while a payment issue is reviewed.
6.13 My Workers, Direct Offers, and Vacation Mode
After a completed Residential Gig, you may privately save a Worker to My Workers and later send that Worker a direct Residential Gig offer. A Worker may accept or decline any direct offer without penalty. A saved-worker relationship does not create employment, exclusivity, an ongoing agreement, or a duty to accept future work.
A Worker in Vacation Mode does not receive new direct offers. YoZombie does not tell Personal Users which specific saved Workers have enabled Vacation Mode. Vacation Mode does not cancel an already accepted Gig.
6.14 Non-Circumvention
You may not bypass the Platform to avoid Platform Fees or move payment off-platform for a Gig that was posted, accepted, or performed through YoZombie (an "Active Gig"). This includes paying a Worker outside the Platform for an Active Gig, asking a Worker to cancel so the work can proceed off-platform, or using a substantially similar off-platform arrangement to avoid fees for work sourced through YoZombie.
6.15 Fraud, Abuse, and Platform Controls
YoZombie may suspend, limit, or terminate access; restrict posting or completion; request additional information; or take payment-flow action where YoZombie reasonably suspects fraud, abuse, unsafe conduct, payment misuse, false identity, account manipulation, or violations of these Terms or Stripe policies. YoZombie may cooperate with payment providers and lawful government requests.
7. Residential Safety, Property Access, and Legal Compliance
7.1 Personal User Responsibility for the Worksite
You are responsible for providing a reasonably safe, lawful, and accurately described worksite and for conditions within your possession or control. You must provide any access, permissions, instructions, and warnings reasonably necessary for the accepted task. You must not conceal or minimize a condition that could affect a Worker's decision to accept or safely perform the Gig.
7.2 Occupied Residential Living Spaces
The Personal side is not intended for entry into occupied residential living spaces. Unless YoZombie expressly enables a category under additional terms, a Residential Gig must be structured for outdoor, driveway, curbside, exterior, garage, pickup, delivery, moving, hauling, cleanup, or similar limited-access work. You may not require a Worker to enter occupied bedrooms, bathrooms, kitchens, offices, basements, attics, or other private living areas as an undisclosed or material part of the Gig.
You may not use vague wording such as "general help" or "other" to bypass access restrictions. If the actual conditions materially differ from the posted access description, the Worker may decline to begin, stop work, communicate through the Platform, or use Report an Issue.
7.3 Children, Vulnerable Persons, Guests, and Pets
A Residential Gig may not be used for childcare, babysitting, elder care, disability care, medical assistance, personal supervision, or any task that places a Worker in charge of another person. You are responsible for supervising minors, vulnerable persons, guests, and occupants and for keeping them away from the work area when reasonably necessary.
You must disclose and safely secure pets or animals that could interfere with access or create risk. The Platform is not intended for animal handling, pet sitting, veterinary assistance, or transport of live animals unless YoZombie expressly enables that category under separate terms.
7.4 Hazards and Material Conditions
Before acceptance, you must disclose known material conditions, including heavy or unusually shaped items, stairs, steep grades, narrow passages, unstable stacks, sharp objects, broken glass, needles, pests, aggressive animals, traffic exposure, weather exposure, slippery surfaces, poor lighting, hidden holes, damaged structures, hazardous substances, human or animal waste, or other conditions that may create risk.
A Worker may stop or refuse work that the Worker reasonably believes is unsafe, unlawful, materially different from the posting, or beyond the Worker's disclosed ability or equipment. Stopping for safety does not automatically decide payment or refund rights; the parties should communicate and may use Report an Issue.
7.5 Unsupported Licensed, Regulated, or High-Risk Work
The Personal side is not designed for home-improvement contracting, skilled-trade work, or other work that requires a professional, occupational, contractor, environmental, transportation, waste, or other license or permit. Unless YoZombie expressly enables a category and states otherwise, you may not post tasks involving:
- alteration, remodeling, repair, replacement, or structural work on a residence;
- electrical, plumbing, gas, HVAC, roofing, chimney, foundation, structural, or major appliance connections;
- tree felling, elevated tree work, roof access, climbing, scaffolding, or other significant fall hazards;
- demolition, excavation, trenching, concrete cutting, or work affecting utilities;
- asbestos, lead, mold remediation, biohazards, pesticides, controlled chemicals, fuel, explosives, or regulated waste;
- firearms, ammunition, weapons, controlled substances, illegal goods, or stolen property;
- medical, nursing, personal-care, security, surveillance, repossession, eviction, or law-enforcement functions;
- transportation of people or any activity requiring a commercial driver, passenger, towing, or carrier license; or
- any activity prohibited by law, insurance restrictions, property rules, or Platform policy.
You are responsible for determining whether a task requires a license, permit, insurance, inspection, contract form, disclosure, or other legal compliance. YoZombie does not make that determination and does not verify licenses or permits.
7.6 Tools, Equipment, Materials, and Protective Gear
You must accurately state whether the Worker is expected to bring tools, equipment, a vehicle, straps, containers, protective gear, or other materials. A Worker is not required to use unsafe, defective, illegal, or undisclosed equipment. Any tools, materials, or protective gear you provide remain your responsibility, including their condition and lawful use.
7.7 Moving, Pickup, Delivery, Hauling, and Disposal
For moving, pickup, delivery, or hauling tasks, you must accurately describe the items, dimensions, weight, pickup and delivery conditions, stairs, loading distance, parking, vehicle needs, and disposal destination. You may not request illegal dumping, abandonment of property, transport of prohibited items, or disposal in violation of local rules. Tipping fees, tolls, parking charges, permits, or other expenses are not included unless clearly disclosed in the Gig and accepted by the Worker.
YoZombie does not verify a Worker's driver's license, vehicle registration, insurance, vehicle condition, cargo capacity, or authority to transport particular items. You are responsible for deciding whether a Worker's proposed transportation arrangement is acceptable.
7.8 Property Damage, Personal Injury, Theft, and Insurance
Personal Users and Workers are responsible for their own conduct, property, insurance, and legal obligations. YoZombie does not provide homeowners, renters, automobile, cargo, general liability, workers' compensation, property, theft, injury, or other insurance for a Residential Gig. Any claim involving property damage, injury, loss, theft, defective work, or another person's conduct is between the affected parties, subject to applicable law and any insurance coverage they maintain.
7.9 Emergencies and Immediate Safety
The Platform is not an emergency service. In an immediate threat to life, safety, property, or public order, contact 911 or the appropriate local emergency authority first. After immediate danger has been addressed, you may preserve relevant Platform records and submit a report. Do not use in-app messaging as a substitute for emergency assistance.
8. Payments, Cancellations, Completion, Refunds, and Reports
8.1 Framework and Payment States
YoZombie provides the Platform and payment workflow. Personal Users and Workers are responsible for the Gigs they agree to. Stripe processes payments; YoZombie controls the Platform completion actions. YoZombie is not a general dispute-resolution service, but it may review reports of platform errors, misuse, fraud, unsafe behavior, payment abuse, or repeated bad conduct and may take account, platform, payment, or refund action under these Terms.
A Residential Gig may move through the following payment-related states:
- Posted / Funded - payment is processed through Stripe as part of posting; no Worker payout occurs.
- Accepted - a Worker accepts the Gig; no Worker payout occurs.
- Started - for a QR-Required Residential Gig, the Worker successfully scans the check-in QR; no Worker payout occurs.
- Awaiting Poster Acceptance - for a Remote Residential Gig, the Worker submits completion; no Worker payout occurs.
- Completed - the applicable completion action occurs and release of Worker Pay is initiated.
- Completion Pending / Review - the normal completion action did not occur or a report or payment issue requires further action; there is no automatic payout and no automatic refund.
8.2 Cancellation Before a Worker Accepts
You may cancel a Residential Gig before a Worker accepts and receive a Full Refund.
8.3 Personal User Cancellation After Acceptance
After a Worker accepts and before a valid QR check-in or Remote completion submission:
- More than one (1) hour before the Scheduled Start Time: you may cancel and receive a Full Refund. The Worker receives no payment.
- Within one (1) hour before the Scheduled Start Time: the Worker receives a $10 Personal late-cancellation payment. The remaining refundable amount, including the ordinary Platform Fee, is refunded to you, less any nonrefundable Transaction Fees. YoZombie retains no ordinary Platform Fee for the canceled Gig.
After a valid QR check-in, the ordinary pre-start cancellation process is no longer available. The Gig must proceed through completion, Completion Pending, or Report an Issue. A Personal User may not misuse cancellation tools to avoid paying for work that has begun or been completed.
8.4 Worker Cancellation
If a Worker cancels after accepting and before beginning the Gig, the Worker receives no Worker Pay and you receive a Full Refund. Repeated or last-minute Worker cancellations are governed by the Worker Terms and may result in Platform action against the Worker.
After a valid QR check-in or Remote completion submission, the Worker may not use the ordinary pre-start cancellation process. If the Worker cannot continue safely or lawfully, the Worker should stop, communicate through the Platform, and use Report an Issue when appropriate.
8.5 QR No-Check-In Cancellation
For a QR-Required Residential Gig, the Worker must scan your check-in QR before starting. Beginning one (1) hour after the Scheduled Start Time, if no valid check-in exists, you may select "Cancel - Worker Did Not Check In" and receive a Full Refund. The Worker receives no Worker Pay and does not receive the $10 late-cancellation payment because the cancellation is based on failure to check in.
You are not required to cancel. If you have not canceled, you may continue communicating and allow the Worker to check in late. Once you cancel for failure to check in, the QR is disabled and any later scan is rejected.
If you selected QR verification but are unavailable or refuse to provide the check-in QR, you must not instruct the Worker to start without check-in. Your failure to provide the selected verification method may be considered in any report, refund, or payment review.
8.6 Remote Missed-Completion Cancellation
For a Remote Residential Gig, the Worker is expected to submit the completed Gig by the Requested Completion Time and may submit during the one-hour grace period that follows. Beginning one (1) hour after the Requested Completion Time, if no completed Gig has been submitted, you may select "Cancel - Gig Was Not Submitted as Completed" and receive a Full Refund. The Worker receives no Worker Pay.
You are not required to cancel and may allow more time. Once the Worker submits completion before you cancel, the missed-completion cancellation option disappears and the Gig proceeds to Awaiting Poster Acceptance.
8.7 YoZombie-Initiated Cancellation
YoZombie may cancel or pause a Residential Gig where YoZombie reasonably suspects fraud, abuse, a safety risk, a violation of these Terms or Stripe policies, or a technical or payment failure. YoZombie may initiate refunds of unreleased funds unless a refund is restricted by Stripe, applicable law, a chargeback, the Personal User's misconduct, or another valid reason. If confirmed work was performed, YoZombie may determine in good faith whether a payment, partial payment, refund, credit, or other adjustment is appropriate for Platform administration.
8.8 QR-Required Check-In and Completion
Before beginning a QR-Required Residential Gig, the Worker must successfully scan your check-in QR. The check-in creates a server-timestamped record and changes the Gig status to Started. Check-in alone does not release payment.
When the work is finished, the Gig is completed in either of two ways:
- Worker checkout scan: the Worker scans your checkout QR. The successful scan records completion, initiates release of Worker Pay, allows YoZombie to retain the Platform Fee, and prevents a second completion action.
- Personal User confirmation: you tap Confirm Completion and confirm that the Worker completed the agreed Gig. This action initiates release of Worker Pay, allows YoZombie to retain the Platform Fee, and disables checkout scanning because the Gig is already completed.
The direct confirmation option exists for flexibility; the Worker is not required to scan out if you have already confirmed completion. However, check-in before starting and checkout when finished provide the strongest Platform record.
If neither completion action occurs, there is no automatic Worker payment and no automatic refund to you. The Gig remains Completion Pending. The parties should communicate through the Platform and may use Report an Issue when appropriate.
8.9 Remote Completion and Personal User Acceptance
A Remote Residential Gig does not use check-in or checkout QR codes. The Worker completes the stated work and submits the completed Gig through the Platform, with any optional photos or completion note. Submission is server-timestamped, changes the Gig to Awaiting Poster Acceptance, and removes the missed-completion cancellation option. Submission does not release payment.
You may review the original scope, submitted completion time, photos, note, messages, and payment amount. If the work was completed as agreed, you must tap Accept Gig as Completed. Acceptance initiates release of Worker Pay, allows YoZombie to retain the Platform Fee, and marks the Gig completed.
If you believe there is a material problem, communicate with the Worker through the Platform and use Report an Issue when appropriate. There is no automatic timeout payment to the Worker, but refusing to accept completed work in an attempt to obtain free labor is payment abuse and may result in payment release, account restriction, suspension, or removal.
8.10 No Automatic Payout and No Automatic Refund
If the applicable completion action does not occur, Worker Pay is not automatically released, no automatic refund is issued to the Personal User, and the Gig is not automatically decided in favor of either side. Worker Pay is not released solely because a Worker claims the work was completed, and a refund is not issued solely because a Personal User claims the work was incomplete. The parties should communicate and may use the report process.
8.11 Refunds and Payment Timing
Refunds, cancellation payments, payouts, credits, and adjustments are processed through Stripe and remain subject to Stripe's rules and financial-institution timelines. Any time estimate shown in the Platform is informational only and not guaranteed. A $10 Personal late-cancellation payment may be reduced by applicable receiver-side Transaction Fees.
After payout is initiated or made available by Stripe, transactions are generally final except to the extent a later adjustment, refund, reversal, chargeback, or legal process is required or permitted by Stripe, applicable law, or these Terms.
8.12 Reporting an Issue - Not General Dispute Resolution
The Platform provides a Report an Issue feature. YoZombie is not a private court, arbitrator, insurer, construction inspector, property-damage adjuster, or general dispute-resolution service for ordinary work disagreements. Ordinary issues should first be handled directly between the Personal User and Worker through in-app messaging.
A Personal User may submit a report involving, for example:
- a QR, checkout, submission, payment, or app problem;
- a Worker no-show, failure to check in, or failure to submit a Remote Gig;
- a material difference between the accepted scope and the work performed;
- unsafe conditions, harassment, threats, theft, or abusive conduct;
- fraud, fake activity, payment abuse, or misuse of cancellation or completion tools; or
- repeated bad conduct or a pattern of complaints.
Reports should be submitted through the in-app report form promptly and ideally within forty-eight (48) hours after the scheduled completion time. Communications or complaints sent outside the Platform may not be treated as reports under these Terms and may limit YoZombie's ability to review the matter, without limiting any non-waivable legal rights.
8.13 Review Scope and Information
Administrative review is intentionally limited to protecting the Marketplace, administering the payment flow, addressing Platform problems, and identifying fraud, safety risks, payment abuse, and repeated bad conduct. YoZombie may consider available Platform records, including:
- the Gig title, description, location, Worker Pay, schedule, and verification method;
- payment status and identifiers available through the Platform;
- QR check-in and checkout records or Personal User confirmation;
- Remote completion submissions, timestamps, photos, and notes;
- in-app messages and activity logs;
- cancellation timing and any $10 late-cancellation payment;
- prior reports, warnings, suspensions, completion failures, or payment issues; and
- photos, screenshots, receipts, or other information submitted with the report.
YoZombie may request clarification or additional documentation. Stripe may restrict, delay, or hold availability of funds during review. YoZombie may retain report records and evidence for operations, audit, fraud prevention, legal compliance, and chargeback defense.
8.14 Review Outcomes and Platform Actions
Based on the information available and these Terms, YoZombie may in good faith take one or more Platform-administration actions, including:
- no action or monitoring only;
- a private administrative note or warning;
- restriction, suspension, or removal of an account;
- release of Worker Pay when appropriate under the Platform rules;
- a full or partial refund when appropriate under the Platform rules;
- a partial payment or adjustment where supported by the Platform process;
- designation of the Gig as a platform error, resolved, unresolved, or Completion Pending; or
- referral of suspected unlawful conduct to an appropriate authority.
These decisions are made for purposes of Platform administration, are not legal judgments, and do not waive rights either party may have under applicable law. No specific review time or outcome is guaranteed. Immediate safety, fraud, active payment abuse, or unlawful-conduct reports may receive priority.
8.15 Chargebacks and Payment Reversals
You agree to attempt to resolve payment issues through in-app communication and the Report an Issue process before initiating a chargeback or other payment reversal. If you initiate a chargeback, YoZombie may restrict or suspend your account and may provide relevant Platform records to Stripe, the card network, a bank, or another payment entity consistent with applicable law.
Repeated, abusive, fraudulent, or bad-faith chargebacks, including chargebacks that contradict clear Platform records, may result in account suspension or termination. To the extent permitted by law, you are responsible for chargebacks, reversals, card-network assessments, bank fees, or other amounts caused by your payment activity or misuse.
8.16 Post-Completion Messaging
After a Residential Gig is completed, the message thread remains open for new messages for twenty-four (24) hours and then becomes read-only. When a Gig is canceled, the thread closes to new messages when cancellation is completed. Read-only history may remain available subject to retention and deletion rules.
9. Rating, Trust, and My Workers
9.1 Work-Again Feedback
After a completed Residential Gig, both parties are asked one question and may answer Yes, No, or Skip. The Personal User is asked, "Would you work with this Worker again?" The Worker is asked, "Would you work with [Personal User Name] again?"
Yes and No responses are used for private Platform oversight and roster decisions. Skip is neutral, creates no penalty, and is excluded from Yes/No percentage calculations.
9.2 No Public Personal Trust Score
Personal Users do not display a public rating or public trust count. Feedback from Workers about Personal Users remains private for YoZombie's administrative oversight. Repeated negative feedback or serious reports may trigger review, but a private flag does not automatically suspend or remove an account.
9.3 Worker Public Trust Count
A Worker's public "Trusted by [N] Businesses" count reflects Business roster saves only. A Personal User's Yes response or decision to save a Worker does not increase or decrease that public count.
9.4 Saving a Worker to My Workers
After a Yes response, the Platform may allow you to save the Worker to your private My Workers roster. My Workers is visible only to you and may be used to send future direct Residential Gig offers. You may remove a saved Worker at any time. Saving or removing a Worker does not change the Worker's public Business trust count.
9.5 Honesty and Prohibited Manipulation
Feedback must reflect the actual completed Gig and must not be false, discriminatory, retaliatory, defamatory, coercive, or manipulated. Users may not create fake Gigs, multiple accounts, coordinated ratings, incentives for positive feedback, or other schemes to alter trust records. YoZombie may remove, adjust, invalidate, or investigate abusive feedback.
9.6 Platform Oversight
Ratings and feedback are subjective user opinions, not verified factual statements or endorsements by YoZombie. To the fullest extent permitted by law, YoZombie is not liable for reputational harm arising from user feedback. YoZombie may remove or anonymize content that it reasonably believes is fraudulent, unlawful, discriminatory, defamatory, or inconsistent with Platform policy.
10. Privacy and Data Use
10.1 Data Collection and Purpose
YoZombie collects information reasonably necessary to operate, improve, and secure the Platform, including account details, contact information, ZIP code, device and activity data, Gig descriptions, exact addresses after acceptance, messages, photos, QR and completion timestamps, payment status, receipts, ratings, saved-worker records, reports, and account history.
YoZombie uses this information for Platform functionality, matching, communication, payment facilitation, fraud prevention, safety and policy review, analytics, compliance, recordkeeping, and support. YoZombie does not sell or rent personal data to third parties.
10.2 Payment Information
Payment credentials and payment-processing information are handled by Stripe. YoZombie does not directly store full card numbers, full bank account numbers, or taxpayer identification numbers. Stripe's terms and privacy policy govern Stripe's processing.
10.3 Address and Location Information
Because Residential Gigs occur at or near personal property, address and location information may be sensitive. The Platform generally limits exact-address disclosure until a Worker accepts the Gig. After acceptance, the address and access information may be shared with the assigned Worker for performance, coordination, safety, payment administration, and report review. You are responsible for avoiding unnecessary disclosure of alarm codes, keys, access credentials, or other sensitive information.
10.4 Data Hosting and Security
YoZombie uses third-party infrastructure, including Firebase and Google Cloud services, for authentication, databases, storage, hosting, messaging, and related functions. YoZombie uses administrative, technical, and organizational safeguards designed to protect information, but no system is completely secure or immune from unauthorized access, loss, or misuse.
10.5 Communication and Messaging
Personal Users and Workers should communicate through the in-app message thread for the Gig. Direct exchange of phone numbers, email addresses, or off-platform payment information for an Active Gig is prohibited. YoZombie does not continuously monitor all messages but may access or review relevant messages when reasonably necessary for safety, fraud, legal compliance, support, or a report.
10.6 Data Sharing and Legal Disclosure
YoZombie may share limited information with service providers that support hosting, analytics, notifications, fraud prevention, payment processing, legal compliance, or Platform operations, subject to appropriate contractual or legal safeguards. YoZombie may disclose information when required by subpoena, court order, lawful government request, payment-network process, or applicable law, or when reasonably necessary to protect rights, safety, or the Platform.
10.7 Breach Notification
If a data breach triggers a legal notification duty, YoZombie will provide notice within the time and manner required by applicable law and will take commercially reasonable steps to investigate and mitigate the incident.
10.8 User Rights and Data Requests
You may request access to, correction of, export of, or deletion of personal information by using available Platform tools or contacting support@yozombie.com. Requests may require identity confirmation and may be limited where records must be retained for active Gigs, payment settlement, fraud prevention, reports, chargebacks, legal holds, tax or accounting duties, or other lawful purposes.
10.9 Data Retention and Privacy Policy
YoZombie retains information only as reasonably necessary for Platform operations, completed transactions, fraud and abuse prevention, reports, legal compliance, tax and accounting obligations, audits, and chargeback defense. Information may be deleted, de-identified, or anonymized when no longer needed, subject to backups and legal holds. The YoZombie Privacy Policy, as updated from time to time, is incorporated into these Terms.
10.10 Cross-Border Processing
Information may be stored or processed in the United States or other jurisdictions where YoZombie or its service providers operate. Applicable privacy rights vary by jurisdiction, and YoZombie will honor rights required by applicable law.
10.11 Data-Security Limitation
To the fullest extent permitted by law, YoZombie is not liable for unauthorized access, loss, alteration, or disclosure of data unless caused by YoZombie's gross negligence, willful misconduct, or another basis for liability that cannot lawfully be excluded.
11. Account Deletion
11.1 Right to Request Deletion
You may request deletion of your Personal account through in-app settings or by contacting support@yozombie.com from the registered account email. YoZombie may require identity confirmation to prevent unauthorized deletion.
11.2 Legal and Operational Limitations
YoZombie may delay deletion until all relevant obligations and risks are resolved, including:
- accepted, upcoming, in-progress, Completion Pending, or Awaiting Poster Acceptance Gigs;
- any Gig scheduled to begin within sixty (60) minutes;
- Stripe charges, transfers, payouts, refunds, reversals, or chargebacks that are not final;
- an unsettled $10 Personal late-cancellation payment;
- open reports, safety reviews, fraud reviews, payment reviews, or policy enforcement;
- a legal hold, subpoena, preservation duty, or other legal restriction; or
- records that must be retained for tax, accounting, consumer, payment, or other compliance purposes.
YoZombie may lock the account while a pending deletion request is being processed. A locked account may be unable to sign in, post, accept completion, send messages, or take other actions, except as YoZombie permits to resolve outstanding obligations.
11.3 Consequences of Deletion
When deletion is finalized, account access is revoked and cannot be restored. Personally identifiable information that is not needed for legal, financial, fraud-prevention, safety, audit, or operational integrity will be deleted from active systems or anonymized. Backup copies and audit logs may retain references during normal system-rotation periods.
Gig, payment, message, rating, report, and completion records may remain in anonymized or limited form where reasonably necessary for transaction history, audit, fraud prevention, chargeback defense, legal compliance, and Platform integrity. Stripe retains information according to Stripe's policies and legal obligations.
11.4 Irreversible Nature of Deletion
Account deletion is final. To use the Platform again, you must create a new account and complete any then-current onboarding, agreement, and payment-provider requirements. YoZombie may restrict re-registration where a prior account was removed for fraud, safety, payment abuse, or policy violations.
11.5 Retention and Compliance Framework
YoZombie applies data minimization and de-identification where feasible and retains only information reasonably necessary for lawful business purposes and required recordkeeping. These deletion terms do not require YoZombie or Stripe to delete records that applicable law or a valid legal process requires them to preserve.
12. Prohibited Uses
12.1 General Restrictions
You may not use the Platform or a Personal account to:
- violate any law, regulation, court order, property restriction, or third-party right;
- post false, deceptive, discriminatory, defamatory, obscene, hateful, violent, harassing, or unlawful content;
- misrepresent identity, property authority, the Gig scope, item condition, hazards, access, weight, payment, or completion;
- use a Personal account for business, commercial, rental, organizational, or property-management activity;
- create hourly shifts, recurring work, ongoing household staff, or an arrangement intended to function as employment;
- post a task requiring entry into an occupied living space contrary to the Personal-side access rules;
- post unsupported licensed, regulated, high-risk, hazardous, illegal, or prohibited work described in Section 7;
- request illegal dumping, trespass, theft, repossession, evasion of law enforcement, or disposal of property without authority;
- harass, threaten, stalk, discriminate against, exploit, coerce, assault, or endanger another user;
- request sexual services, nudity, intimate contact, dating, companionship, or other adult services;
- request childcare, elder care, medical care, personal supervision, or transportation of people;
- circumvent Platform payments, completion records, QR steps, fees, safety controls, or account restrictions;
- create fake Gigs, duplicate accounts, fraudulent reports, manipulated ratings, false completion records, or chargeback abuse;
- use bots, scrapers, automated systems, or unauthorized interfaces to access, copy, manipulate, or overload the Platform;
- reverse-engineer, copy, sell, sublicense, or commercially exploit Platform code, data, or systems;
- introduce malware, ransomware, malicious code, or unauthorized tracking or surveillance tools; or
- collect, publish, sell, or misuse another user's personal information.
12.2 AI and Automated Manipulation
You may not use artificial intelligence, automation, synthetic media, deepfakes, or generated identities to deceive users, fabricate Gig evidence, misrepresent property or work, manipulate reviews, impersonate another person, or create misleading postings or messages. You may not use Platform data to train or develop an external model without YoZombie's written permission.
12.3 Payment Integrity
You may not solicit or make off-platform payment for an Active Gig, interfere with Stripe verification or payment processing, manipulate the Gig scope or completion status to avoid fees, refuse legitimate completion solely to obtain free work, or initiate a fraudulent or bad-faith chargeback.
12.4 Monitoring and Enforcement
YoZombie does not undertake to monitor all Platform activity and is not responsible for user conduct or User Content merely because it appears on the Platform. YoZombie may use automated tools and human review to detect potential fraud, safety risks, payment abuse, or policy violations and may investigate or act when appropriate.
12.5 Consequences of Violation
Violations may result in removal of a Gig, restriction of features, payment or refund holds, warnings, suspension, termination, preservation of records, legal action, or referral to a payment provider or lawful authority. Enforcement decisions take effect when issued but may be reviewed, corrected, or reversed for error, fraud, new information, technical problems, legal requirements, or changed circumstances.
13. Liability and Indemnification
13.1 Marketplace Role and User-to-User Risk
YoZombie provides technology that connects independent users. YoZombie is not a party to the service agreement between a Personal User and Worker and does not own, control, inspect, secure, or maintain the property, items, vehicles, tools, worksite, or work performed. To the fullest extent permitted by law, YoZombie is not liable for the acts, omissions, representations, negligence, intentional conduct, work quality, nonperformance, injury, death, property damage, theft, loss, trespass, or disputes of a Personal User, Worker, occupant, guest, property owner, driver, or other third party.
13.2 No Guarantee of Workers or Outcomes
YoZombie does not guarantee that a Worker will accept a Gig, arrive, check in, submit completion, possess particular skills, use particular methods, carry insurance, have a valid license, safely operate a vehicle, or complete work to your satisfaction. Ratings, saved-worker status, search placement, Platform records, Stripe verification, and prior Gig history are not warranties or endorsements.
13.3 Platform Provided "As Is"
To the fullest extent permitted by law, the Platform is provided "as is" and "as available," without warranties of any kind, express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, title, accuracy, non-infringement, uninterrupted operation, error-free performance, or availability of any Worker, Gig, payment method, feature, or result.
13.4 Limitation of Liability
To the maximum extent permitted by law, YoZombie's total cumulative liability for claims arising out of or relating to these Terms, the Platform, a Personal account, or any transaction between users will not exceed the greater of (1) one hundred U.S. dollars ($100) or (2) the total Platform Fees you paid to YoZombie during the twelve (12) months preceding the event giving rise to the claim.
To the maximum extent permitted by law, YoZombie will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use, loss of property value, lost profits, lost opportunity, emotional distress, reputational harm, data loss, or replacement-service costs, regardless of legal theory and even if advised of the possibility.
These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, including any liability established for YoZombie's gross negligence, willful misconduct, fraud, or violation of a non-waivable legal duty where applicable law so requires.
13.5 Personal User Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless YoZombie and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, penalties, and reasonable legal expenses arising from or related to:
- your violation of these Terms or applicable law;
- your User Content, Gig description, representations, instructions, or account activity;
- your lack of authority over property, items, access, pickup, delivery, disposal, or the requested work;
- a concealed, undisclosed, or unsafe condition within your possession or control;
- your negligent, reckless, fraudulent, or intentional act or omission;
- your use of the Personal side for commercial, employment, licensed, regulated, or prohibited work;
- a dispute between you and a Worker or another person concerning a Residential Gig; or
- a claim that your conduct, posting, payment activity, or requested work violated a third party's rights.
YoZombie may assume control of the defense of a matter subject to indemnification, in which case you agree to cooperate. This Section does not require indemnification for YoZombie's own gross negligence, willful misconduct, or other liability that cannot lawfully be shifted.
13.6 Insurance
You are responsible for determining whether your homeowners, renters, automobile, umbrella, or other insurance applies to a Residential Gig and whether additional coverage is appropriate. YoZombie does not provide insurance advice and does not represent that any loss will be covered.
13.7 Survival
This Section survives suspension, termination, deletion, and expiration of the Account or these Terms to the extent necessary to resolve claims, payment matters, reports, or legal obligations.
14. Governing Law and Arbitration
14.1 Governing Law and Mandatory Local Protections
These Terms and any dispute, claim, or controversy arising out of or relating to them, the Platform, or the relationship between you and YoZombie are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration provisions. Mandatory consumer protections of your state of residence remain applicable to the extent they cannot lawfully be waived.
14.2 Required Informal Resolution
Before initiating arbitration against YoZombie, you must provide written notice describing your name, account email, the facts of the dispute, and the relief requested. Send the notice to support@yozombie.com and the mailing address in Section 18. If the dispute concerns a Gig, you must also use the in-app Report an Issue process when available. If the dispute is not resolved within thirty (30) days after YoZombie receives sufficient notice, either party may proceed as permitted below.
14.3 Agreement to Binding Individual Arbitration
Except where prohibited by law and except for the small-claims and equitable-relief provisions below, disputes between you and YoZombie will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and applicable Consumer Due Process Protocol then in effect.
BY AGREEING TO THESE TERMS, YOU AND YOZOMBIE WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
14.4 Arbitration Procedure, Location, and Fees
Arbitration will be conducted by one neutral arbitrator. Consistent with the AAA Consumer Rules, the proceeding may occur by documents, telephone, video, or an in-person hearing reasonably convenient to the consumer. The arbitrator may award any individual relief available under applicable law and may enter a final and binding award enforceable in a court of competent jurisdiction.
Arbitration fees will be allocated under the AAA Consumer Rules and applicable law. You will not be required to pay more than the consumer filing amount permitted by those rules, and YoZombie will pay the amounts the rules require a business to pay. Each party bears its own attorneys' fees unless the arbitrator awards fees under applicable law or the AAA rules.
14.5 Class and Representative Action Waiver
All claims must be brought in the parties' individual capacities. No arbitrator may combine claims of different persons or preside over a class, collective, consolidated, private-attorney-general, or representative proceeding unless all affected parties and YoZombie agree in writing after the dispute arises.
If a court or arbitrator determines that a portion of this waiver is unenforceable for a particular claim or request for public injunctive relief, that portion will proceed in a court of competent jurisdiction and may be stayed while arbitrable claims are resolved.
14.6 Small Claims Court
Either party may bring an individual claim in a small claims court of competent jurisdiction, including a qualifying court in the county where you reside or Anne Arundel County, Maryland, so long as the claim remains individual and within that court's jurisdiction.
14.7 Equitable Relief
YoZombie may seek temporary, preliminary, or permanent injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property, confidential systems, payment integrity, non-circumvention obligations, or against unauthorized access, fraud, or misuse. Seeking such relief does not waive arbitration of other claims.
14.8 Thirty-Day Arbitration Opt-Out
You may opt out of the arbitration and class-action-waiver provisions by sending a written opt-out notice within thirty (30) days after first accepting these Terms. The notice must include your full name, Personal account email, mailing address, and a clear statement that you opt out of arbitration. Send it to support@yozombie.com and the mailing address in Section 18. Opting out does not affect any other part of these Terms and does not affect a prior arbitration agreement you did not timely opt out of.
14.9 Survival
This Section survives suspension, termination, deletion, or expiration of the Account or these Terms.
15. Updates to Terms
15.1 Right to Modify
YoZombie may update, modify, or replace these Terms to reflect changes in operations, features, fees, technology, law, risk, or regulatory requirements. Unless a shorter period is required by law or necessary for immediate safety, security, fraud prevention, or legal compliance, material changes will take effect thirty (30) days after notice.
15.2 Notice of Changes
YoZombie may provide notice through the Platform, email, an in-app banner, a pop-up acknowledgment, or another reasonable electronic method. The updated version will display a revised Last Updated date.
15.3 Continued Use
Continued use after the effective date of updated Terms constitutes acceptance. If you do not agree, you must stop using Personal-account features and may request account deletion subject to Section 11.
15.4 Immediate Legal or Safety Updates
YoZombie may implement a change immediately when required by law, payment-provider rules, a government directive, an urgent security or safety need, or a material fraud risk. Notice will be provided as soon as reasonably practicable.
15.5 Historical Versions
YoZombie may retain historical versions for compliance, audit, and determining which terms applied to a particular transaction. A prior version may be requested by contacting support@yozombie.com.
16. Force Majeure
16.1 Events Beyond Reasonable Control
YoZombie is not liable or in default for a failure or delay caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fire, flood, public-health emergencies, war, terrorism, civil unrest, power or telecommunications failures, labor or material shortages, failures of Stripe, Google, Firebase, banks, card networks, or other service providers, government orders, cyberattacks, or internet and hosting interruptions.
16.2 Effect
During a Force Majeure event, affected Platform obligations and timeframes may be suspended or extended for a reasonable period. YoZombie may cancel affected Gigs, waive a cancellation payment, issue a credit, or initiate a refund when appropriate and permitted by Stripe and applicable law. YoZombie will make commercially reasonable efforts to resume normal operations.
16.3 Existing Payment Obligations
A Force Majeure event does not automatically cancel a payment obligation already earned or lawfully incurred. Payments and refunds remain subject to the completion, report, Stripe, and legal processes described in these Terms.
17. Severability, Waiver, Entire Agreement, Assignment, and Electronic Consent
17.1 Severability
If any provision is invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision will be severed and the remaining Terms will remain in effect, except as otherwise stated in the arbitration provisions.
17.2 No Waiver
A failure or delay by YoZombie to exercise a right or remedy is not a waiver. Any waiver by YoZombie must be in writing and signed by an authorized representative.
17.3 Entire Agreement and Incorporated Policies
These Terms, the Privacy Policy, the accepted Gig terms, any feature-specific terms, and applicable Stripe terms constitute the entire agreement between you and YoZombie concerning Personal-account use. They supersede prior or contemporaneous communications about that subject. The separate service agreement between you and a Worker is based on the accepted Gig terms and is not a contract with YoZombie.
17.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without YoZombie's written consent. YoZombie may assign these Terms to an affiliate, successor, purchaser, or entity involved in a merger, reorganization, financing, or sale of assets, subject to applicable law.
17.5 Electronic Consent and Communications
By creating an Account, clicking "I Agree," posting or paying for a Gig, tapping a completion or cancellation action, or continuing to use the Platform, you consent to conduct transactions and receive agreements, disclosures, notices, receipts, and other communications electronically. These electronic actions and records may satisfy legal writing and signature requirements under the federal Electronic Signatures in Global and National Commerce Act and the Maryland Uniform Electronic Transactions Act, Md. Code, Commercial Law Section 21-101 et seq., to the extent applicable.
You are responsible for maintaining a valid email address, compatible device, internet access, and the ability to retain or print electronic records. You may withdraw consent to electronic communications by discontinuing Platform use and requesting account deletion, but withdrawal does not affect the validity of prior electronic transactions or records.
17.6 Headings and Interpretation
Headings are for convenience only and do not limit the meaning of a provision. The words "including" and "includes" mean "including without limitation." No provision will be interpreted against a party solely because that party drafted it.
17.7 Survival
Provisions that by their nature should survive termination, including payment obligations, record retention, prohibited uses, intellectual property, liability limitations, indemnification, arbitration, and this Section, will survive.
